1. Acceptance of Terms

Welcome to Nami (the “App”), a baby name inspiration tool created and operated by Everkin (“Company,” “we,” “us,” or “our”). These Terms of Service (“Terms”) constitute a legally binding agreement between you and Everkin (“Company,” “we,” “us,” or “our”) governing your use of the App.

By downloading, installing, or using the App, you agree to be bound by these Terms. If you do not agree to these Terms, do not use the App.

2. Eligibility

You must be at least 17 years old to use this App. By using the App, you represent and warrant that:

  • You are at least 17 years of age

  • You have the legal capacity to enter into these Terms

  • Your use of the App complies with all applicable laws and regulations

We reserve the right to terminate accounts of users who do not meet these eligibility requirements.

3. Description of Service

Nami is a mobile application that provides:

  • AI-powered baby name suggestions using artificial intelligence

  • Searchable database of baby names with meanings and origins

  • Personal favorites collection

  • Collaborative shared lists for couples and families

  • Cultural and linguistic information about names

The App is designed to help expecting parents and families explore baby name options. It is not a legal, medical, or cultural advisory service.

4. AI-Generated Content Disclaimer

 

4.1 Nature of AI Suggestions

The App uses artificial intelligence (OpenAI’s GPT models) to generate name suggestions based on your search criteria. Important disclaimers:

  • Suggestions Only: All AI-generated names and meanings are suggestions, not recommendations or endorsements

  • No Guarantees: We do not guarantee the accuracy, cultural appropriateness, or suitability of any suggested names

  • Verify Independently: You are solely responsible for verifying the meaning, origin, pronunciation, and cultural significance of any name before using it

  • Cultural Sensitivity: AI models may not fully understand cultural, religious, or regional sensitivities. Always consult appropriate cultural resources or experts

  • No Liability: We are not responsible for any consequences arising from your choice of name, including but not limited to cultural misappropriation, mispronunciation, or unintended meanings

4.2 AI Limitations

AI-generated content may:

  • Contain factual errors or inconsistencies

  • Reflect biases present in training data

  • Provide culturally inappropriate suggestions despite filtering

  • Generate duplicate or nonsensical results occasionally

We recommend cross-referencing AI suggestions with reputable name databases, cultural experts, and native speakers.

5. User Accounts and Authentication

 

5.1 Anonymous Authentication

The App uses anonymous authentication by default:

  • No email, phone number, or personal information required

  • A unique anonymous identifier is created for your device

  • You can optionally set a nickname for shared lists

5.2 Account Security

You are responsible for:

  • Maintaining the security of your device

  • Not sharing your device with unauthorized users

  • Logging out of shared devices

We are not liable for unauthorized access to your account due to your failure to secure your device.

5.3 Account Termination

We reserve the right to terminate or suspend accounts that:

  • Violate these Terms

  • Engage in abusive or fraudulent behavior

  • Exceed usage limits excessively or attempt to circumvent restrictions

  • Use the App for illegal purposes

6. Usage Limits and Fair Use Policy

 

6.1 Free Tier Limits

To ensure fair access and manage costs, free users are subject to:

  • 5 AI name generations per day

  • 20 AI name generations per month

  • 500 global daily generations (all users combined)

  • 5,000 global monthly generations (all users combined)

6.2 Exceeding Limits

When you reach your limit:

  • You will receive a notification within the App

  • AI generation features will be temporarily unavailable

  • Other features (favorites, shared lists) remain fully functional

  • Limits reset at midnight UTC (daily) and on the 1st of each month (monthly)

6.3 Abuse Prevention

Attempts to circumvent usage limits may result in:

  • Account suspension

  • Permanent ban from the service

  • Legal action (in cases of fraud or hacking)

Examples of prohibited circumvention:

  • Creating multiple accounts to exceed limits

  • Using automated scripts or bots

  • Exploiting bugs or vulnerabilities

6.4 Paid Tiers (Future)

We may introduce paid subscription tiers in the future with:

  • Higher or unlimited AI generations

  • Premium features and priority support

  • Pricing and terms will be disclosed before purchase

7. User-Generated Content

 

7.1 Your Content

You retain ownership of content you create, including:

  • Favorite names lists

  • Shared lists

  • Custom notes or annotations

  • Nickname

By using the App, you grant us a worldwide, non-exclusive, royalty-free license to store, process, and display your content solely for providing the service.

7.2 Shared Lists

When you create a shared list:

  • You can invite others by sharing a 6-character code

  • Collaborators can view, add, and remove names from the list

  • You (as the owner) can delete the list at any time

  • Collaborators can leave the list at any time

You are responsible for who you share list codes with. Do not share codes publicly or with untrusted parties.

7.3 Prohibited Content

You may not use the App to create, share, or store content that:

  • Is illegal, harmful, threatening, abusive, or harassing

  • Infringes intellectual property rights

  • Contains hate speech, discriminatory language, or promotes violence

  • Is sexually explicit or inappropriate for a parenting app

  • Contains malware, viruses, or malicious code

Violation of these rules may result in immediate account termination and legal action.

7.4 Content Moderation

We reserve the right (but have no obligation) to:

  • Monitor user-generated content

  • Remove content that violates these Terms

  • Report illegal activity to law enforcement

We are not responsible for content created by users.

8. Intellectual Property Rights

 

8.1 Our Content

The App, including but not limited to:

  • Software code and architecture

  • User interface design

  • Logos, trademarks, and branding

  • Name database (where applicable)

  • Original written content

…is owned by Everkin or our licensors and protected by copyright, trademark, and other intellectual property laws.

You may not copy, modify, distribute, sell, or reverse engineer any part of the App without our written permission.

8.2 Third-Party Content

The App uses:

  • OpenAI’s API for AI-generated suggestions (subject to OpenAI’s Terms)

  • Public domain name databases and resources

  • Open-source libraries (see licenses in the App’s “About” section)

Third-party content is subject to the respective owners’ terms and licenses.

8.3 Feedback

If you provide feedback, suggestions, or ideas:

  • We may use them without compensation or attribution

  • You grant us a perpetual, irrevocable license to implement and commercialize such feedback

  • No confidential relationship is created

9. Privacy and Data Protection

Your privacy is important to us. Please review our Privacy Policy (available in the App’s Settings screen) to understand:

  • What data we collect

  • How we use your data

  • Your rights under GDPR, CCPA, and other privacy laws

  • How to delete your data

By using the App, you consent to our data practices as described in the Privacy Policy.

10. Disclaimers and Limitations of Liability

 

10.1 No Warranties

THE APP IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO:

  • Merchantability or fitness for a particular purpose

  • Accuracy, reliability, or completeness of content

  • Uninterrupted or error-free operation

  • Security or freedom from viruses

We do not warrant that the App will meet your requirements or that AI suggestions will be suitable for your needs.

10.2 Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE SHALL NOT BE LIABLE FOR:

  • Indirect, incidental, special, or consequential damages

  • Loss of profits, data, or goodwill

  • Damages arising from your use or inability to use the App

  • Damages arising from AI-generated suggestions or name choices

  • Damages caused by third-party services (Supabase, Firebase, OpenAI)

Our total liability for any claims shall not exceed $100 USD or the amount you paid us in the past 12 months (whichever is greater).

10.3 Cultural Appropriateness

We are not responsible for cultural, religious, or social consequences of name choices. You are solely responsible for:

  • Researching cultural significance and appropriateness

  • Consulting with community elders, religious leaders, or cultural experts

  • Verifying pronunciation and meanings in relevant languages

  • Understanding potential social or legal implications of name choices

Example Scenarios Where We Have No Liability:

  • Choosing a name with unintended negative meanings in another language

  • Using a culturally sacred or restricted name without proper permission

  • Selecting a name that causes legal or administrative issues in your country

  • Experiencing social backlash for a name choice

10.4 Medical and Legal Disclaimer

The App does not provide medical, legal, or professional advice. We are not responsible for:

  • Legal name registration requirements in your jurisdiction

  • Medical considerations related to naming or pregnancy

  • Family or relationship disputes arising from name choices

  • Legal disputes over name ownership or usage rights

Consult appropriate professionals (lawyers, doctors, cultural advisors) for specific guidance.

11. Indemnification

You agree to indemnify, defend, and hold harmless Everkin, its affiliates, officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including legal fees) arising from:

  • Your violation of these Terms

  • Your violation of any third-party rights (intellectual property, privacy, etc.)

  • Your use or misuse of the App

  • Content you create or share

  • Your choice of baby name based on App suggestions

12. Changes to Terms

We reserve the right to modify these Terms at any time. Changes will be effective:

  • Immediately upon posting for non-material changes

  • 30 days after notification for material changes

Notification Methods:

  • In-app notification

  • Email (if you provided contact information)

  • Updated “Last Updated” date at the top of these Terms

Continued use of the App after changes constitutes acceptance of the modified Terms.

13. Termination

 

13.1 Your Right to Terminate

You may stop using the App at any time. To permanently delete your data:

  1. Open the App

  2. Go to Settings (Profile tab)

  3. Tap “Delete My Data”

  4. Confirm deletion

13.2 Our Right to Terminate

We may suspend or terminate your access:

  • For violations of these Terms

  • For suspected fraudulent or illegal activity

  • If required by law or court order

  • At our discretion with or without notice

13.3 Effect of Termination

Upon termination:

  • Your access to the App will cease

  • Your data will be deleted according to our Privacy Policy (within 30 days)

  • You must cease all use of the App

  • Provisions regarding liability, indemnification, and intellectual property survive termination

14. Dispute Resolution

 

14.1 Governing Law

These Terms are governed by the laws of the state of California, without regard to conflict of law principles.

14.2 Informal Resolution

Before filing a claim, you agree to contact us at [email protected] to attempt informal resolution. We will respond within 15 business days.

14.3 Arbitration (US Users)

For users in the United States:

  • Any disputes will be resolved through binding arbitration (not court)

  • Arbitration will be conducted by the American Arbitration Association (AAA)

  • Arbitration will take place in the state of California

  • You waive your right to a jury trial and class action lawsuits

Exception: You may bring claims in small claims court if they qualify.

14.4 International Users

For users outside the United States:

  • Disputes will be resolved in the courts of the state of California, United States

  • EU users: You have the right to lodge complaints with your local consumer protection authority

15. Miscellaneous

 

15.1 Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Everkin regarding the App.

15.2 Severability

If any provision of these Terms is found invalid or unenforceable, the remaining provisions will remain in full effect.

15.3 Waiver

Our failure to enforce any right or provision does not constitute a waiver of that right or provision.

15.4 Assignment

You may not assign or transfer these Terms. We may assign or transfer these Terms in connection with a merger, acquisition, or sale of assets.

15.5 Force Majeure

We are not liable for delays or failures caused by circumstances beyond our reasonable control (e.g., natural disasters, wars, pandemics, internet outages).

15.6 App Store Terms

Your use of the App is also subject to the terms of service of the platform from which you downloaded the App:

In case of conflict, these Terms prevail except where prohibited by platform policies.

These Terms of Service are effective as of November 11, 2025 and will remain in effect except with respect to any changes in its provisions in the future, which will be in effect immediately after being posted (or after the applicable notice period).

  2. Respect usage limits – Fair use ensures the service remains available for everyone

  3. Protect your device – Anonymous authentication means anyone with access to your device can access your data

  4. Research thoroughly – Consult cultural experts, name databases, and native speakers before finalizing name choices

  5. Delete your data anytime – Use Settings → Delete My Data to permanently remove all your information
